1. About these terms
These Terms of Service ("Terms") govern your access to and use of the website at infosecurs.com and the products, platform and services we provide (together, the "Services"). The Services are operated by Infosecurs™ Limited ("Infosecurs", "we", "us" or "our"), a company registered in England and Wales under company number 13693292, with its registered office at 4 Derby Street West, Ormskirk, Lancashire, L39 3NH.
By accessing the website or using the Services, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organisation, you confirm that you have authority to bind that organisation. If you do not agree, you must not use the Services.
2. The Services
Infosecurs provides human risk management services, including security awareness training, phishing simulation, policy management and related reporting. We may add, change or remove features from time to time to improve the Services. Where a separate order form, subscription agreement or statement of work has been signed between us and your organisation, that agreement governs the commercial supply of the Services and takes precedence over these Terms to the extent of any conflict.
3. Accounts and access
Certain features require an account. You are responsible for keeping your login credentials confidential, for all activity that occurs under your account, and for ensuring that the information you provide is accurate and kept up to date. You must notify us promptly at [email protected] if you suspect any unauthorised use of your account.
4. Acceptable use
You agree not to, and not to permit any third party to:
- use the Services in breach of any applicable law or regulation;
- attempt to gain unauthorised access to, disrupt or interfere with the Services or the systems or networks connected to them;
- reverse engineer, copy, resell or create derivative works of the Services except to the extent permitted by law;
- upload or transmit malicious code, or content that is unlawful, infringing or harmful; or
- use the Services to send unsolicited communications except where expressly provided for as part of an authorised simulation programme.
5. Customer content and responsibilities
You retain ownership of the data and content you or your users provide to the Services ("Customer Content"). You grant us the rights necessary to host and process Customer Content in order to provide the Services. You are responsible for the accuracy and legality of Customer Content and for having any consents required to provide it to us. Our handling of personal data is described in our Privacy Policy.
6. Intellectual property
The Services, including all software, content, training materials and trademarks, are owned by or licensed to Infosecurs and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Services for your internal business purposes for the duration of your subscription.
7. Availability
We work hard to keep the Services available and secure, but we do not guarantee that they will be uninterrupted or error-free. We may suspend access for maintenance, security or operational reasons, and will aim to give reasonable notice of planned downtime where practicable.
8. Warranties and disclaimers
Except as expressly stated in these Terms or a signed agreement, the Services are provided "as is" and "as available", and we disclaim all other warranties to the fullest extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any loss of profits, revenue, goodwill, or any indirect or consequential loss arising out of or in connection with the Services. Our total aggregate liability arising out of or in connection with the Services will be limited as set out in the applicable signed agreement or, where none exists, to the amount paid by you for the Services in the twelve months preceding the claim.
10. Term and termination
These Terms apply while you use the Services. We may suspend or terminate your access if you materially breach these Terms and fail to remedy the breach within a reasonable period of being notified. On termination, your right to use the Services ceases; provisions which by their nature should survive termination will do so.
11. Changes to these terms
We may update these Terms from time to time. Where changes are material, we will take reasonable steps to notify you. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
